Petitioner is in custody in connection with Mokama P.S. Case No. 120/2018 (Spl.Case No. 4581/2018) for the offence under sections 30(a), 37(b) & 38 of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case there is seizure of 40 liters of Toddy but nothing was recovered from the possession of the petitioner. The petitioner is in custody since 15.5.2018.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody since 15.5.2018 and there is no recovery from the conscious possession of this
