The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that after partition in the family, as a result of dispute between the brothers, Vijay Sao gave a farsa blow on the head of the husband of the deceased who subsequently died. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From perusal of the FIR it would transpire that the allegation of
Patna High Court CR. MISC. No.26144 of 2021(2) dt.26-11-2021 2/2 assault is only against Vijay Sao. The petitioner is in custody since 27.1.2021 and has no criminal antecedent. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts of the case together with chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Gangabridge P.S. Case no. 79 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
