JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-09-2017 The petitioner seeks regular bail in connection with Nokha (Dharmpura) P.S. Case No. 219 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 506, 504, 324 and 379 of Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of firing causing injury to one Vishnu Kumar.
It has been submitted on behalf of the petitioner that there is case and counter case between the parties in the background of land dispute and though there is allegation of firing causing injury to the injured, however, injury sustained by the said injured was found to be simple in nature, whereas the injury sustained by two persons from the side of the petitioner was found to be grievous in
Patna High Court Cr.Misc. No.41187 of 2017 (2) dt.07-09-2017 nature. Further petitioner has been in judicial custody since 16.07.2017.
Learned counsel for the State opposed the prayer for bail stating that though the fire arm injury caused to the said Vishnu Kumar is simple in nature, however, the same was on head, which is a vital part of the body.
Having heard both sides, considering the fact and circumstances of the case this application is disposed of with direction to court below to release the petitioner on bail once charge is framed in this case or petitioner completes four months in judicial custody, whichever is earlier.
