JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 448 of 2014 for the offences instituted under Section 379 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that Kriloskar Diesel Pumping Set was stolen from the agricultural field. The case is lodged against unknown.

It has been submitted on behalf of the petitioner that the informant is harassing the petitioner by instituting false cases against him. It has been pointed out that earlier also the informant had instituted a case against the petitioner in which the police had submitted final form. It is further submitted that the petitioner has

On behalf of the State it has been submitted that the petitioner's name appeared in course of investigation. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected in connection with Bhabua P.S. Case No. 448 of 2014, pending in the court of the learned C.J.M., Kaimur at Bhabua. If the petitioner surrenders in the court below within a period of six weeks the court below shall consider the case of the petitioner on its own merit without being prejudiced by the order of this Court.
