JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 34 of the Indian Penal Code.

The prosecution case is that on 23.02.2016 at 6.30 P.M. the petitioner along with two other unknown persons started assaulting the informant near railway crossing at Badhiyabagh Shivganj. On protest being made petitioner took out country made pistol and resorting to firing causing injury in his abdomen and after sustaining injury the informant fell down the petitioner and his associates took away Rs. 25,000/-, mobile and golden chain of the informant.

No.19784 of 2016 (2) dt.04-05-2016 2/2 It is submitted by the learned counsel for the petitioner that the informant did not sustain any fire arm injury and in fact the informant fell down near railway track in inebriated condition and sustained some injuries. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Sasaram Town (M) P.S. case No. 269 of 2016 pending in the court of learned CJM, Rohtas at Sasaram.

This application is disposed of with the aforesaid observation/direction.
