JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to the issued after cognizance being taken for the offences punishable under Sections 323, 324, 380 and 504 of the Indian Penal Code. It is alleged that due to filing of petition before the Surpanch by the complainant, the accused persons came armed with lathi, danda and rod when Prem Rajan assaulted on the back side of the complainant and when Ved Prakash and Om Prakash came to rescue then the accused entered into the shop and Prem Ranjan, petitioner no.1 who took away `30,000/- and other article. It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.24998 of 2015 (2) dt.30-06-2015 2/2 at earlier point of time, the mother of petitioner no.1 filed Hasanpur P.S. Case No. 88 of 2014 making accusation under Sections 323, 385, 379, 354 and 506/34 of the IPC against the complainant and others and present complaint has been filed as a retaliatory measure to the same. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Rosera, Samastipur in connection with C.R. No. 675 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
