The petitioner is languishing in custody since 26.05.2017 in a case for the offence registered under Sections 195, 406, 420 and 120(B) of the IPC.

The prosecution story, in brief, is that some miscreants looted a truck loaded with turmeric qand and spices worth Rs. 40,00,000/- of the informant.

It has been submitted by learned counsel for the petitioner has falsely been implicated in the present case due to mistake of fact. The charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Except for suspicion, there is no

Patna High Court Cr.Misc. No.42790 of 2017 (2) dt.20-09-2017 2/2 other substantive evidence to suggest the implication of this petitioner. No wrongful gain or loss has been caused on the part of the petitioner.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 121/2017.
