2. The petitioners seek bail in connection with Special Case No. 16 of 2024 (NDPS Act) arising out of Sadar Muffasil P.S. Case No. 883 of 2023 registered for the offence under Section 8(c), 21(b) and 29 of the NDPS Act, 1985 and under Section 78 of the JJ Act, 2015.

3. As per the prosecution case, 105 gms of Smack has been recovered from the petitioner no. 1 and 100 gms of Smack has been recovered from the petitioner no. 2.

4. It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and they have no criminal antecedent. He further submits that the petitioners are in custody since 23.10.2023.

5. Considering the recovery of intermediate quantity from both the petitioners, this application is allowed.

6. Let the petitioners, above named, be released on bail after framing of charge if the charge has not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea in connection with Special Case No. 16 of 2024 (NDPS Act) arising out of Sadar Muffasil P.S. Case No. 883 of 2023.

7. As a condition of this order, the bailors should be blood relatives of the petitioners.
