This is an application for bail in connection with Sherghati (Dobhi) P.S. Case No. 152 of 2014 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the FIR and the case is under Section 302 IPC.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and other co-accused persons have been granted bail in Cr.Misc.No. 15849 of 2015, vide order dated 8.6.2015, in Cr.Misc.No. 18016 of 2016, vide order dated 24.8.2016 and in Cr.Misc.No.48041 of 2016, vide order dated 29.11.2016 and petitioner is in custody since 4.2.2016. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.40864 of 2017 (2) dt.04-09-2017 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 152 of 2014, subject to the following conditions :- (1) One of the bailors shall either be a public representative or Government Official having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
