Petitioner, already in custody since 07.04.2018, seeks bail in connection with Tarapur P.S. Case No. 01 of 2018 registered under Sections 376, 511 and 448/34 of the Indian Penal Code. Allegation in brief is that the petitioner used to call the informant on mobile and one night scaled the wall and entered inside the house with one of his associates and tried to pin her down for committing rape, in the meanwhile, her husband turned up and petitioner escaped away but his accomplice was apprehended at the spot.

Learned counsel for the petitioner submits that the petitioner is the co-villager of the prosecutrix, a married lady, and the person who was apprehended at the spot was granted

Patna High Court Cr.Misc. No.36376 of 2018(3) dt.04-07-2018 2/2 bail by the court below itself and the mobile from which the call is alleged to be made to the prosecutrix does not belong to the petitioner and the petitioner bears clean antecedent. Having considered the aforesaid facts and circumstances, petitioner Mukesh Kumar @ Ranvir is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Munger in connection with Tarapur P.S. Case No.01 of 2018.
