The petitioner, in the present case, is seeking regular bail in connection with Manpur P.S. Case No. 41 of 2018, registered for offences alleged under Sections 147, 148, 149, 341, 332, 353, 290, 292, 307 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 of the Arms Act.

It is submitted on behalf of the petitioner that as per allegation in course of a caste rivalry, firing was taking place and when police reached there the petitioner was trying to flee away but caught with one magazine containing five live cartridges. Learned counsel submits that no firearm has been recovered from his possession, the petitioner has no criminal

Patna High Court Cr.Misc. No.33354 of 2018 (2) dt.14-06-2018 2/2 antecedent and is in custody since 18.03.2018. Learned APP for the State is present.

Considering the facts and circumstances of the case wherein the petitioner has no criminal history and it is alleged that one magazine containing five live cartridges were recovered, let the petitioner above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Nalanda at Bihar Sharif in connection with Manpur P.S. Case No. 41 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
