The petitioner seeks bail in anticipation of his arrest in connection with Manpur P. S. Case No. 100 of 2018 dated 12.07.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 337 and 379 of the Indian Penal Code.

From the narration made in the F.I.R., it has been

No.15546 of 2019(2) dt.14-03-2019 2/3 alleged by the wife of the driver, who had earlier trampled down a child because of his negligent driving, that he was assaulted at the hands of the petitioner and others. Learned counsel for the petitioner has pointed out from the petition that with respect to the death of a toddler, a case was lodged on 26.06.2018 against the driver namely the husband of the informant of the present case. It was only after 15 days thereafter, that the wife of the aforesaid driver has lodged this case against the petitioner and others. It further appears that one of the similarly situated accused persons has been granted anticipatory bail by a Bench of this Court, which order has been annexed along with this petition.

Considering the afore-mentioned facts and the general and omnibus allegation of having assaulted the husband of the informant for having killed a small baby because of his faulty driving, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this

No.15546 of 2019(2) dt.14-03-2019 3/3 order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Manpur P. S. Case No. 100 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
