JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sidhwaliya Police Station Case No. 179 of 2012 registered for the offences punishable under Section 414 of the Indian Penal Code and section 11(i) (a) (d) (f) of prevention of Cruelty to Animal Act.
The name of petitioner was disclosed by driver and Khalasi, who were caught on the spot but submission on behalf of the petitioner is that the seized cattle have already been released in favour of one Mohammad Aslam by the learned court below and as a matter of fact, petitioner does not have any concerned with the seized cattle.
Patna High Court Cr.Misc. No.12030 of 2015 (3) dt.19-05-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Sidhwaliya Police Station Case No. 179 of 2012 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
