JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Buxar Mufassil P.S. Case No. 141 of 2018 for the offence under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 18.05.2018. Learned counsel submits that the seizure list was not prepared as per the mandatory provision prescribed under Section 100 of Cr.P.C.

Considering the fact that the petitioner has remained in custody for about 11⁄2 months and he has no criminal antecedent, the petitioner, named above, is directed to be released on bail on

Patna High Court Cr.Misc. No.36169 of 2018 (2) dt.28-06-2018 2/2 furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II-Cum-Special Judge, Excise Act, Buxar in connection with Buxar Mufassil P.S. Case No. 141 of 2018.
