The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

The villagers of Belwa Lakhanpur village caught one Guddu Singh with two bags of rice and handed over to the Lauriya police. On enquiry, it was found that less quantity of rice was supplied by the petitioner being PDS dealer to the consumers and used to sell the grains in black market. It is submitted by learned counsel for the petitioner that recovery is not from the petitioner and only on suspicion the accusation has been levelled. A statement has been made in

Patna High Court Cr.Misc. No.21030 of 2015 (2) dt.19-05-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lauriya P.S. Case No.134 of 2014, pending before the learned Chief Judicial Magistrate, West Champaran, Bettiah.

With the above observation, this application is, accordingly, disposed off.
