The petitioners seek bail in a case registered under Sections 272 & 273 of the Indian Penal Code, Section-30 of Bihar Prohibition and Excise Act and Sections 25(1-B)a/26 of the Arms Act as well as 20/22 of the NDPS Act. Allegedly, two country made stain guns, three country made pistols, six live cartridges, nine litres wine and two kg. Of Ganja are recovered.

It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 01-02-2020.

Patna High Court CR. MISC. No.15409 of 2020(2) dt.03-03-2020 2/2 Two country made stain guns, three country made pistols, six live cartridges, nine litres wine and two kg. Of Ganja are alleged to have been recovered from courtyard of joint house of the petitioners. The petitioners had no knowledge regarding the alleged incidence. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Ist, Nawada in connection with Nawada Town P.S. Case No. 382 of 2017 giving rise to Special (NDPS) Case No. 11 of 2019.
