This application for regular bail in connection with Sessions Trial No. 534 of 2019, arises out of Barharia P.S. Case No. 148 of 2019, disclosing offence punishable under Sections 304-B/ 34 of the Indian Penal Code.

The petitioner is in custody since 03.06.2019. He is the husband of the deceased. His application for regular bail was earlier rejected twice by this Court. By making this application the petitioner has renewed his prayer for bail. A status report was called for from the court below as regards present stage of trial. A report dated 23.04.2022 has been received, from which it transpires that though charge was

Patna High Court CR. MISC. No.16969 of 2022(3) dt.11-05-2022 2/2 framed on 18.02.2020, till date no prosecution witness has been produced before the trial court.

Considering the fact that the petitioner is in custody since 03.06.2019 and there is no substantial progress at the trial, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J.-IX, Siwan in Sessions Trial No. 534 of 2019, arising out of Barharia P.S.
