Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Islampur P.S. Case No. 491 of 2019, registered for the offences punishable under Sections 409, 420 of the Indian Penal Code. Prosecution case in brief is that petitioner no.1, petitioner no. 2 and petitioner no. 3 have misappropriated an amount of Rs. 6,30,658/- (Rs. Six lac thirty thousand six
Patna High Court CR. MISC. No.15907 of 2020(2) dt.14-07-2020 2/3 hundred fifty eight) illegally from the account no. 71930100049750 for their own use despite of the stay order of operation of bank account by the District Education Officer. It is submitted that petitioners have been falsely implicated in this case. Petitioner no. 1 is the then Principal, petitioner no. 2 is Clerk and petitioner no. 3 is lecturer of the same College. The entire allegation is false, not a single farthing has been misappropriated by these petitioners rather the same was distributed amongst the staff as salary on the direction of Managing Committee. The entire transaction was done through cheque. There is no allegation against petitioner no. 2 and petitioner no. 3. Petitioners have got clean antecedent. However, learned counsel for the informant vehemently opposed the prayed for bail.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Hilsa, Nalanda in connection with Islampur P.S. Case No. 491 of
