The petitioner is languishing in custody since 28.01.2017 in a case for the offence registered under Sections 302/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that the accused persons including the petitioner stopped the brother of the informant and abused and shot fire at him as a result of which, he died.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the
Patna High Court Cr.Misc. No.42960 of 2017 (2) dt.20-09-2017 2/2 petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Purnea, in connection with Sessions Trial No. 169 of 2017, CIS 169/2017, arising out of Banmankhi P.S. Case No. 18 of 2017.
