This application for anticipatory bail arises out of Begusarai Muffasil P.S. Case No. 54 of 2019 for the offence under Section 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

From a godown, the Block Supply Officer is said to have seized 85 quintals of rice, leading to registration of First Information Report. It is alleged that the said godown is owned by the petitioner. It is, however, indicated in the First Information Report itself that the said godown has been let out by him to someone else.

Learned counsel appearing on behalf of the petitioner has submitted that without verifying the conduct of the person, who was rented the godown, the petitioner has been

Patna High Court CR. MISC. No.19211 of 2019(2) dt.29-03-2019 2/2 named in the First Information Report only because the godown is owned by him Be that as it may, in the facts and circumstances of the case, case for grant of anticipatory bail is made out. This application is accordingly allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Begusarai, in Begusarai Muffasil P.S. Case No. 54 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
