===================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2018 The petitioner seeks bail in connection with Saur Bazar P.S. Case No. 123 of 2018 dated 07.03.2018 instituted for the offences under Sections 341, 323, 379, 307, 204, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner and several others are alleged to have come to the house of the brother of the informant and during the course of attack, brother of the informant was shot at. Even his wife was targeted. The brother of the informant received gun shot injury.
The specific role has been assigned to some of the accused persons. So far as petitioner is concerned, he is only
Patna High Court Cr.Misc. No.35259 of 2018 (2) dt.06-07-2018 2/2 stated to have taken away the valuables and belongings of the informant and his brother and also threatened while leaving the place of occurrence. This allegation is against all the accused persons including the petitioner. The learned counsel for the petitioner has submitted that he has not been attributed with opening fire at anybody. The petitioner is in custody since 07.03.2018 and does not have any criminal antecedent.
Regard being had to the aforesaid facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar P.S. Case No. 123 of 2018.
