====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 25-03-2026 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in connection with Konch P.S. Case No.508 of 2025 registered for the offence under Sections 191(2), 329(2), 126(2), 115(2), 109, 74, 352 of BNS.

3. As per prosecution case, on 24.10.2025 at around 07:00 AM, while the informant was going to pluck vegetables from his farmland, meanwhile Kaushal Yadav came and asked to him to give pathway in his land then informant reply that when he would build his house then he give way to them and has started shouting and abusing. Further he alleged that when informant's wife and sister have come after the hearing abusive

Further all the accused persons came with lathi and Danda to the informant's house and started assaulting the informant and his whole families due to which the informant's head got cracked and when the co- villagers have come there then all were fled away. Accordingly, the FIR.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence and they have falsely been implicated in this case. Learned counsel for the petitioners further submits that there is general and omnibus allegation against petitioner no.1 and 2 and the specific allegation of assault is on petitioner no.3, but the same is simple injury. Further submits that the petitioners do not have any criminal antecedent.

5. The learned APP opposes the anticipatory bail application.

6. There is general and omnibus allegation against petitioner no.1 and 2. Specific allegation of assault is on petitioner no.3, but the same has resulted in simple injury, as per supplementary injury report, which has been brought on record. Further the petitioners do not have any criminal antecedent. Considering all these aspects of the matter, this Court inclined to

Accordingly, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, VI, Gaya in connection with Konch P.S. Case No.508 of 2025, subject to the conditions laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
