The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 504/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Prosecution case is of assaulting the informant and abusing by calling caste name.
It is submitted by learned counsel for the petitioners that no injury was caused to the informant and at earlier point of time the informant got lodged SC/ST P.S. Case No.57/2014 with similar accusation through the daughter wherein the petitioners have been granted anticipatory bail and thereafter the
Patna High Court Cr.Misc. No.18829 of 2016 (2) dt.03-05-2016 2/2 present case has been lodged.
It appears from the learned Sessions' Judge order that the investigation has already been concluded and the petitioners have been charge-sheeted but keeping in view of the fact that in the earlier case, lodged with similar accusation, the petitioner has been granted anticipatory bail, it is a case for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Wazirganj P.S. Case No.313/2014, pending before the learned CJM, Gaya. With the above observation, this application is, accordingly, disposed off.
