The petitioner seeks bail in connection with Sourbazar (Pastpar) P.S. Case No. 501 of 2019, registered under Section 392 of the Indian Penal Code.

The accusation is that in the late evening of 29.12.2019, some unknown miscreants came boarding on two motorcycles at the petrol pump of the informant, Ashish Kumar, and snatched cash of Rs.1,30,200/-. Out of two bikes, one was red colour splendor and the other was blue colour Apache motorcycles.

Submission is that in fact, the petitioner is accused in three cases, as detailed in paragraph 3, out of which he has been acquitted in Sourbazar P.S. Case No. 170 of 2017 and in two

No.16054 of 2020(2) dt.05-06-2020 2/2 cases he is on bail due to that reason, mere on suspicion, the investigating officer of this case apprehended the petitioner and got recorded his confessional statement showing his involvement and involvement of one Shiv Kumar and Kundan Kumar. The petitioner is in custody since 31.12.2019, but, he has not been put on test identification parade. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sourbazar (Pastpar) P.S. Case No. 501 of 2019 to the satisfaction of the Chief Judicial Magistrate, Saharsa, subject to the condition that out of two bailors, one must either be parent or close relative of both the petitioner.
