The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 120B of the I.P.C. and Section 30(a), 32(ii) of Bihar Prohibition and Excise Act.

48 bottles of 180 ml. (i.e. 8.64 liters) foreign liquor has been recovered from the motorcycle of this petitioner, which was parked in the house of co-accused Prince Kumar, where huge quantity of illicit foreign liquor has been recovered. It is submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.16113 of 2022(3) dt.22-07-2022 2/2 opposed the prayer for anticipatory bail and submitted that petitioner is registered owner of motorcycle, from which, illicit liquor has been recovered.

Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
