JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-04-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier rejected vide order dated 05.07.2023 passed in Cr. Misc. No. 1124 of 2022.

It is a case of recovery of 32 Kgs of Ganja from a Tata Indica Car and petitioner was said to be the driver of the alleged car.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.21869 of 2024(3) dt.26-04-2024 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has no concern with the alleged recovered contraband and the vehicle in question does not belong to him. The petitioner is languishing in custody since 14.09.2022. In pursuance to the direction of this Court, a report with regard to the present stage of the case has been received which has been kept at Flag-R. The report of learned Special Judge(N.D.P.S) cum Additional District & Sessions Judge-I, Aurangabad dated 20.03.2024 suggests that trial will be concluded within six months.

In that view of the matter, the petition is disposed off with a direction to the learned Court below to expedite the trial and conclude the same within stipulated period of time as mentioned in its report 20.03.2024.

The petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a
