JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 19-08-2017 Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in connection with Daudnagar P.S. Case no. 80 of 2017 registered under Sections 354, 504, 506, 109/34 of the I.P.C., and Section 8 of POCSO Act. The petitioner is said to have dragged the minor daughter of the informant with bad intention intruding into her house finding her alone. When the informant approached the petitioner and his family member for making complain, they extended threatening of dire consequences.
It is submitted by the learned counsel for the petitioner that the petitioner is a co-villager and due to some petty dispute of dumping the garbage by the informant in front of the door of the petitioner, he has been falsely implicated in this case by the
Patna High Court Cr.Misc. No.39649 of 2017 (2) dt.19-08-2017 2/2 informant. The petitioner has been languishing in custody since 18.04.2017.
Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Aurangabad in connection with Daudnagar P.S. Case no. 80 of 2017.
