The petitioner apprehends his arrest in Barauni (Refinery) P.S. Case No. 67/2016, registered for the offences punishable under Sections 366A, 34 of the Indian Penal Code. The petitioner and one Pankaj Kumar are alleged to have kidnapped the minor daughter of the informant while she had gone to take tuition.

It is submitted that there is no eye-witness of the occurrence. Nobody has seen the petitioner going along with Pankaj Kumar or the victim girl, but it appears from para 32 of case diary that mobile of petitioner and Pankaj Kumar was found in the same location and they are changing their places of living. Considering the facts aforesaid and the fact that mobile
