This is an application for bail in connection with Kashim Bazar P.S. Case No. 135 of 2017 registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code.

Allegation against the petitioner is of committing theft in the house and the petitioner is not named in the F.I.R. Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion having no criminal antecedent and he is in custody for two and half months. Further submission is that other accused, who have been arrested along with the petitioner, have already been granted bail by a Bench of this Court vide order dated 20.9.2017 passed in Cr. Misc.

Patna High Court Cr.Misc. No.47189 of 2017 (2) dt.17-10-2017 2/2 No.42774 of 2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Kashim Bazar P.S. Case No.135 of 2017 subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned.

(2) Petitioner shall co-operate in trial and appear on each and every date and on failure to appear on two consecutive dates without showing any genuine ground or without permission of court, his bail bond shall be cancelled.
