JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Petitioner is in custody in connection with Barachatti P.S. Case No. 334 of 2018 for the offence under sections 30(a), 38, 47 of the Bihar Excise (Amendment)Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 19.5.2018 in connection with seizure of 30 liters of Mahua wine. He submits that petitioner is a lady and as such she deserves consideration for bail.

Considering the fact that petitioner is a lady and she is in custody since 19.5.2018 and she has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned court of Special Judge, Excise, Gaya, in connection with Barachatti P.S. Case No. 334 of 2018.
