JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467 and 120B of the Indian Penal Code.
It is alleged that the petitioner made two applications in his own name with two different photographs with same parentage and address during recruitment of Constable in Bihar police. It is submitted by the learned counsel for the petitioner that since the petitioner was not selected at the examination and some information was sought for by the co accused under R.T.I. Act, then the present case has been lodged with malicious accusations. The parentage and address of two applicants are different. The prosecution has been launched after conclusion of
Patna High Court Cr.Misc. No.31290 of 2014 (4) dt.18-03-2015 2/2 recruitment process. It is further submitted that similarly situated co-accused has been granted anticipatory bail vide Cr. Misc. No. 50484 of 2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Shastri Nagar P.S. Case No. 136 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
