JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER -------------- 24-06-2015 Heard learned counsel for the petitioners. However, none appears on behalf of the opposite parties. The present MJC application has been filed for restoration of CWJC No. 21123 of 2014 which stood dismissed on account of non-compliance of the court's peremptory order dated 12.12.2014 within time.

Learned counsel appearing on behalf of the petitioners submits that the aforesaid order dated 12.12.2014 was complied with, but after delay of three days. According to him, delay was not intentional.

In view of the aforesaid submissions and assertions made in paragraphs 4 and 6 of the present application, the prayer for restoration is allowed. CWJC No. 21123 of 2014 is directed to

Patna High Court MJC No.989 of 2015 (2) dt.24-06-2015 3/3 be restored to its original file, subject to verification of the assertions made in paragraphs 4 and 6 of the present application. The present MJC application stands allowed to the extent indicated above.
