The petitioner is apprehending his arrest in connection with Dighwara P.S.Case No.33 of 2018 registered for offences punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story clearly discloses that the petitioner has fired on the deceased causing his death.

Submission of the learned counsel for the petitioner is that the FIR itself shows that the occurrence took place in the marriage ceremony, in such a situation, making specific allegation against the petitioner does not appear to be probable. Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the fact that the

No.24520 of 2019(5) dt.13-08-2019 2/2 specific allegation is against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders and pray for regular bail, the same shall be considered on its own merit by the learned court below. With the aforesaid direction, this application is dismissed.
