The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code. Later on Section 411 of I.P.C. was added.
Allegation is that some unknown thieves have stolen three computers, two printers, two fans, one card disk, five packet papers etc. from the RTPS office, Pandaul. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.11.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has come on his self confession
Patna High Court CR. MISC. No.14571 of 2020(2) dt.03-03-2020 2/2 made before the police. One mobile is alleged to have been recovered, but the same is not stolen property. The petitioner has not been put on T.I.P.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Pandaul P.S. case No.271 of 2019.
