JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,302,120B and 379 of the Indian Penal Code. It is alleged that all the accused persons including the petitioners came variously armed when co accused Baleshwar Ray caused fire arm injury on the chest of the grand father of the informant and co accused Dineshwar Ray snatched the rifle from the grand father of the informant, thereafter the accused persons escaped from the scene.

No.25508 of 2015 (2) dt.30-06-2015 2/2 It is submitted by learned counsel for the petitioners that specific accusation of firing is against co accused Baleshwar Ray who is not petitioner before this court and Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
It is submitted by learned counsel for the informant that the FIR was lodged by the victim against the petitioners and in a pre-plan manner the grant father of the informant has been killed.
Considering the fact that the accusation of firing is against co accused Baleshwar Ray, let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Barahara P.S. Case No. 101 of 2015 pending in the court of learned CJM, Bhojpur at Ara.
This application is disposed of with the aforesaid observation/direction.
