JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The appellant seeks regular bail in connection with Kangali P.S. Case No. 10 of 2017, registered for offences punishable under Sections 341, 342, 323, 504, 506 and 366(A) of the Indian Penal Code and Section 3(i)(x)(w) of the SC/ST Act. Allegation against the appellant is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the appellant that he has been made accused in this case only on the basis of suspicion. No specific allegation has been attributed to him and even nobody has even seen him going with the girl. Further he has been in judicial custody since 03.07.2017.

Learned counsel for the State as well as learned counsel for the informant opposed the prayer for bail on the ground that

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the appellant on bail, this appeal for regular bail is, accordingly, dismissed.
