The petitioner has filed this petition for modification of order dated 27.03.2014 passed in Cr. Misc. No. 5050 of 2014 by which the petitioner was granted bail on the condition that the petitioner would deposit Rs. 6,20,000/-.
Learned counsel for the petitioner submits that the petitioner is the sole member of his family and therefore, he is not in a position to manage the money for depositing the same. It appears that it was the petitioner who was entrusted with Rs. 32,97,800/- for keeping the same in ATM but the petitioner instead of keeping the money in ATM kept the money with him and misappropriated the same.
Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.33658 of 2014 (2) dt.05-01-2015 modify the order dated 27.03.2014 passed in Cr. Misc. No. 5050 of 2014. Accordingly, this modification petition is dismissed. (Prabhat Kumar Jha, J.) KKSINHA/- U T
