JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in Tiyar P.S. Case No.27 of 2017 registered under Sections 147, 148, 149, 341, 323, 325, 307, 302 and 504 of the Indian Penal Code.
As per the prosecution case, the petitioner along with other accused persons are said to have assaulted the nephew of the informant and the informant, while one co-accused Mannu Singh assaulted on the head of the nephew of the informant by means of rod.
It is submitted by learned counsel for the petitioner that the allegations levelled against the petitioner is not specific rather general and omnibus in nature. It is the injury inflicted by the accused Mannu Singh to the deceased by iron rod which
Patna High Court Cr.Misc. No.38034 of 2017 (02) dt.10-08-2017 2/2 proved fatal. The doctor, who has conducted the postmortem of the deceased, has also found only one injury on the head of the deceased. The petitioner has been languishing in custody since 24.05.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhojpur at Arrah in connection with Tiyar P.S. Case No.27 of 2017.
