In this case, the petitioners are seeking anticipatory bail in connection with Ismilepur P.S. Case No. 52 of 2018, registered for the offence under Sections 341, 323, 308, 504 and 506/34 of the Indian Penal Code.
On account of fighting of cow of both the sides altercation took place. Allegation has been made that the petitioner side assaulted the informant with lathi and danda and caused injury on the head of the informant.
Learned counsel for the petitioners submits that from the order of the Court below it appears that the injury
Patna High Court CR. MISC. No.18353 of 2019(2) dt.27-03-2019 2/2 sustained by the informant is simple in nature caused by hard and blunt substance.
Looking to the entire facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Naugachhiya, Bhagalpur or successor Court, in connection with Ismilepur P.S. Case no. 52 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
