The case arises out of Rajpur P.S. Case No. 185 of 2021 for the offence under sections 147, 148, 341, 323, 504, 307, 379 and 325 of the Indian Penal Code in which the petitioner is in judicial custody since 14.2.2022 (as stated in para-14 of the bail application).

Allegation against the petitioner amongst other is that not only he exhorted the other co-accused to assault his own agnates, he also assaulted his own nephew namely, Deshantar Kumar causing serious injury on his head.

Considering the specific allegation against the petitioner of having assaulted his nephew on the head as also the fact that although the FIR was lodged in August, 2020, it was

No.16386 of 2022(2) dt.14-07-2022 2/2 only in February, 2022 that the petitioner came into judicial custody, this Court, for the present, is not inclined to grant any relief to the petitioner and the bail application is hereby rejected. The trial court is directed to expedite the trial and conclude the same.
