The petitioner, in the present case, is seeking regular bail in connection with Mairwa P.S. Case No. 85 of 2018 registered for offences alleged under Sections 419, 420, 467, 468, 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no specific complaint by any person that this petitioner has ever attempted to cheat him by exchanging the fake currency notes, however, on the confidential information said to have been received by police the petitioner was arrested with two notes of rupees one hundred each lying in his pocket and 5 notes of rupees two thousand which were fake currency kept in a bundle with 12

Patna High Court Cr.Misc. No.37258 of 2018 (2) dt.28-06-2018 other notes prepared by folding papers. Learned counsel submits that the petitioner is in custody since 19.03.2016 and has no criminal antecedent.

Learned APP for the State is present.

Considering the facts and circumstances of the case whereunder the alleged recovery of fake currency notes has been made from the pocket of the petitioner but there is no specific complaint by any person as it appears from the first information report that he had cheated someone, at this stage, for the purpose of bail, I am inclined to accept the submission of the learned counsel for the petitioner. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Mairwa P.S. Case No. 85 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
