1. Heard learned counsel for the petitioners and learned A.P.P. for the State Mr. Ravindra Kumar along with learned counsel for the informant.

2. The learned counsel for the petitioner after some arguments seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1 and 2, namely, Bipin Kumar and Sonu Kumar, respectively.

3. Permission is accorded.

4. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 341, 323, 307, 504 and 506 of the Indian Penal Code.

5. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a student. It is further submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that though there is allegation of assaulting the side of the informant but then there is no specific allegation of assault against the petitioner.

6. Learned A.P.P. Mr. Ravindra Kumar along with learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioner. The learned counsel appearing on behalf of the informant submits that Abhishek and Aman, who are sons of the informant are alleged to have been assaulted by the side of the petitioners and they have suffered grievous injury but then does not dispute the submission made on behalf of the learned counsel for the petitioner that petitioner is a student.

7. The learned counsel for the petitioner submits that in the event if the petitioner is sent to judicial custody, the chances are bright that he may come in contact with hardened criminals and his future prospect will also get affected.

8. Considering the submissions made by the learned counsel for the petitioner, the petitioner Niraj Kumar, in the event of his arrest or surrender before the learned Court below

No.22524 of 2024(2) dt.24-04-2024 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakhisarai P.S. Case No.754/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
