In the present writ application, the petitioner has prayed for grant of the following relief:- "(i) To issue an appropriate order/s, direction/s including a writ preferably in the nature of mandamus commanding and directing upon the respondents to make correction of father's name of the petitioner in the Secondary School Examination Certificate and marksheet held in the year 2019.

2/4 (ii) To direct the respondents to issue fresh certificate and marksheet to the petitioner with respect to the Secondary School Examination which the petitioner passed in the year 2019 after making correction in the father's name of the petitioner in which the name has been wrongly mentioned in Baijnath Sahrma in place of Baijnath Sharma deliberately and knowingly.

(iii) To any other relief/s to which the petitioner may be found entitled in the facts and circumstances of the case."

After Advancing some argument, learned counsel for the petitioner submits that for seeking the aforesaid relief(s), the petitioner has already filed a representation dated 02.12.2026 (Annexure-P/5) before the Secretary, Bihar School Examination Board, Patna, which till today, continues to be pending. He, therefore, submits that the petitioner would be satisfied if an appropriate direction could be issued to the Secretary of the Bihar School Examination Board to dispose of the pending representation of the petitioner within a fixed time-frame, after giving an opportunity of hearing to the petitioner.

4. Learned counsel appearing for the Bihar

3/4 School Examination Board submits that the representation (Annexure-P/5) filed by the petitioner is belated and, therefore, the relief claimed by the petitioner is not fit to be entertained. She also submits that even a direction for disposal of the representation would not be the proper course of action.

Having noted the submission made by learned appearing for the Bihar School Examination Board, this Court is of the view that since a very limited nature of the prayer has been made by learned counsel for the petitioner, therefore, it would be in the interest of justice to dispose of this writ application, directing the Secretary of the Bihar School Examination Board to dispose of the pending representation of the petitioner dated 02.12.2024 (Annexure-P/5) within three months from the date of receipt/production of a copy of this order, after giving an opportunity of hearing to the petitioner. In case, the petitioner is found entitled to the relief(s) which the petitioner is claiming through the representation, the same should be extended to the petitioner within a further period of three months from the date of final disposal of the representation.
