The petitioner is languishing in custody since 05.12.2018 in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

The prosecution case got initiated on the basis of written report of Arjun Kumar, head clerk, Civil Court, Arwal submitted before the Station House Officer, Arwal Police Station is to the effect that on 03.12.2018 at 11.30 A.M., one Pravesh Kumar came to the office of the informant and shown appointment letter of Group- C and D post which appeared to

On enquiry, co-accused Pravesh Kumar suggested that the petitioner Dina Nath Raushan brought him to get appointed and co-accused Ashok Singh and Rajeev were also involved in the said racket and they also received Rs.5 lac for getting him appointment on the said post.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against co-accused Pravesh Kumar, who has been granted bail by a Co-ordinate Bench of this Court vide order dated 08.03.2019, passed in Criminal Miscellaneous No. 14529 of 2019. It is further submitted that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the appointment was being sought in the Civil Court on the basis of forged appointment letter.

Considering the thrust of accusation against coaccused Pravesh Kumar, who has already been granted bail by a Co-ordinate Bench of this Court and the the investigation has already being concluded coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
