The petitioner has preferred this application for grant of regular bail in a case registered under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, it is stated that 551.310 litres of IMFL was recovered from the Anganwari Centre no. 58 and the accused persons including the petitioner herein managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. The cause of his false implication is his antecedent under the Bihar Prohibition and Excise Act, 2016 which he has

Patna High Court CR. MISC. No.26680 of 2021(2) dt.26-11-2021 2/2 stated in the supplementary affidavit. He is in custody since 28.1.2021 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation in the FIR together with charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no. 307 of 2020, P.R. no. 5 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
