The petitioner apprehends his arrest in Desari P.S. Case No. 232/2014, registered for the offences punishable under Sections 419, 420 and other Sections of the Indian Penal Code. The informant alleged that Sumangal Singh cousin father-in-law gifted the entire property to her but Santosh Kumar Singh purchased the land from one Vijay Kumar Singh, the petitioner of RSP No. 396 area 5 Kathas, Khata no. 76. It is submitted that Sumangal Singh was the maternal grand-father of the petitioner Vijay Kumar Singh. Sumangal Singh had a daughter namely, Alodhan Devi. Alodhan Devi executed sale-deed in the year 1986 with regard to land Khata no. 79, RSP
Patna High Court Cr.Misc. No.30847 of 2015 (2) dt.30-07-2015 2/2 No. 1290 but the informant did not raise any objection. The land which was sold by the petitioner was never challenged by the informant. The dispute appears to be of civil nature. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 232/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
