JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-01-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the Informant. The petitioner apprehends his arrest in connection with Phulparas P.S. Case No. 380 of 2019 registered under Sections 447, 341, 323, 324, 308, 379 and 504/34 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against him. Petitioner is a man of clean antecedent. Learned A.P.P. appearing on behalf of the State and learned counsel for the informant opposed the prayer of the petitioner by contending that on perusal of first information

Patna High Court CR. MISC. No.14543 of 2020(8) dt.21-01-2022 2/2 report, it is evident that petitioner abused the informant and assaulted him by means of Fersa on his head. Hence, petitioner does not deserve to be enlarged on anticipatory bail. Having considered the facts and the submissions made on behalf of the parties, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
