2. The petitioner apprehends his arrest for the offences alleged under Section 498(A) of the Indian Penal Code registered in connection with Complaint Case No. 956 C of 2009.

3. It is submitted that the petitioner has been falsely implicated and in any event, the petitioner reiterates that he is ready and willing to keep the opposite party no. 2 with due dignity and honour and it is she who is not interested in the company of the petitioner. This is the first complaint of this nature filed by the opposite party no. 2 since the parties were married on 18.04.2006. The petitioner claims clean antecedents and has not misused the privilege of provisional bail earlier granted by this Court.

4. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 24.07.2015 by this Court in connection with Complaint Case No. 956 (c) of 2009 pending in the

Patna High Court Cr.Misc. No.27509 of 2015 (9) dt.22-02-2017 2/2 Court of learned S.D.J.M. Sadar at Motihari, East Champaran is hereby confirmed subject to the following further conditions: (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) The petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) Md. Ibrarul/BT U T
