ANJANA MISHRA ORAL ORDER 16-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.12.2017 in connection with Kalyanpur P.S. Case No.216 of 2017 registered for the offence under Sections 399, 402 of the Indian Penal Code, Section 25(1-b)A, 26, 35 of the Arms Act and Sections 20, 22, 23, 24, 25,27 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that so far as the petitioner is concerned, only a mobile was recovered from his possession and no contraband item was recovered. Recovery of Charas is alleged to be from the possession of one Vinay Sahni and not this petitioner.

Patna High Court Cr.Misc. No.36855 of 2018 (2) dt.16-07-2018 2/2 Considering the aforementioned facts and circumstances and that the petitioner has already been in custody since 13.12. 2017, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Spl. Judge, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No.216 of 2017.
