JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 10.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Rosera P. S. case no. 50/2015 registered under sections 307, 379 and other allied sections of the Indian Penal Code. Petitioners are said to have assaulted the informant and Vikash Kumar and in that course, petitioner no.2 snatched golden chain and purse of the informant.

Learned counsel for the petitioners submits that alleged occurrence is said to have taken place in the evening of 7.3.2015 and after that so-called injured Vikash Kumar got examined, himself, in Primary health center but, as a matter of fact, no injury was found on the person of the informant or on injured Vikash Kumar. It is further contended by him that the

Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Rosera, Samastipur in Rosera P. S. case no. 50/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
